Terms of Service

Welcome to Scalita! These Terms of Service ("Terms") govern your use of the Scalita mobile application (the "App") provided by Pablo Dominguez ("we," "our," or "us"). By downloading, installing, or using Scalita, you agree to these Terms.

1. Acceptance of Terms

By using Scalita, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Scalita is a vocal warmup application designed for singers. The App provides:

  • Built-in and custom musical scales for practice
  • Warmup routines with customizable settings
  • Vocal range detection (optional)
  • Piano playback for scale practice

3. Free and Pro Versions

Free Version: Scalita is free to download and use with full access to built-in content, limited custom scale/routine creation (3 each), and all playback features.

Pro Version: A one-time in-app purchase ($7.99 USD) unlocks unlimited custom scales and routines. Pro is a non-subscription, one-time purchase that grants permanent access to Pro features.

4. Purchases and Refunds

All purchases are processed through Google Play. By making a purchase, you agree to Google Play's terms of service. Refund requests should be directed to Google Play according to their refund policy. We do not directly process payments or have access to your payment information.

5. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Scalita for personal, non-commercial purposes in accordance with these Terms. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App's systems

6. User Content

You retain ownership of any content you create within the App, such as custom scales and routines. This content is stored locally on your device. When you export and share content, you are responsible for how that content is used.

7. Audio Samples

Scalita uses piano samples from the Salamander Grand Piano project, which are in the public domain. The App's use of these samples does not grant you any rights to extract, redistribute, or use these samples outside of the App.

8. Disclaimer of Warranties

SCALITA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • The results from using the App will be accurate or reliable
  • Any errors in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF SCALITA.

10. Health Disclaimer

Scalita is designed as a practice tool for singers. It is not a substitute for professional vocal training or medical advice. If you experience any pain, discomfort, or vocal strain while using the App, stop immediately and consult a healthcare professional or voice specialist.

11. Changes to the App

We may update, modify, or discontinue any aspect of Scalita at any time without notice. We are not liable for any modification, suspension, or discontinuation of the App.

12. Changes to Terms

We may revise these Terms at any time by updating this page. Your continued use of the App after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Termination

We may terminate or suspend your access to Scalita at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your license to use the App will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.
